Real Estate Photo Licensing Agreement
Copyright and Licensing
Reside Photography retains full copyright ownership of all images produced during business operations and displayed on this website. The real estate broker/agent (hereafter referred to as “CLIENT”) commissioning the photography is granted a limited license to use the purchased images solely to market the specified property while the CLIENT manages the listing. This license automatically terminates when the property is sold, expired, or withdrawn. Any editing or alteration of the images beyond minor cropping or resizing is strictly prohibited unless performed by Reside Photography.

The CLIENT may not transfer, sell, or license the images to any third party, including property owners, other agents, brokers, builders, architects, stagers, or vendors. Violation of these terms constitutes copyright infringement under the Digital Millennium Copyright Act of 1998 (17 U.S.C. §512(c)) and may result in legal action.

Reside Photography acknowledges that the CLIENT has no control over how the images are shared by MLS or syndicated to property listing websites (e.g., Zillow, Trulia).
Reside Photography reserves the right to re-license images for commercial use to developers, builders, designers, or other parties. Such agreements will be handled separately and independently.

Floorplans Disclaimer
Floorplans provided are for general reference only and may not reflect precise measurements or dimensions. For accurate measurements, consult a qualified professional. Reside Photography is not responsible for any inaccuracies or discrepancies in floorplans.

Image Retention and Backup
Images are securely stored for 90 days from the original delivery date. Upon request, they can be re-delivered within this period. Beyond 90 days, image availability cannot be guaranteed. To ensure continued access, the CLIENT should create a local backup of all files.

When the CLIENT’s agreement with the homeowner ends—whether due to property sale or transfer to another agent—the image license expires. At this time, the CLIENT must delete any backup files to comply with the license terms.

Failure to Perform
If Reside Photography is unable to complete the shoot due to illness, emergency, fire, casualty, act of God or causes beyond the control of Reside Photography, Reside Photogrshall make every attempt to provide a Substitute Photographer or reschedule the shoot. Further, if Reside Photography is unable to deliver photographic materials due to technological malfunctions, including but not limited to the equipment operation and image processing, or photographic materials are otherwise lost or damaged without fault of the Reside Photography, Reside Photography will make every attempt to remedy the situation.

Rescheduling & Cancellation

If for any reason the CLIENT needs to reschedule or cancel prior to scheduled day of the shoot, there shale be no charge. All reschedules or cancellations requested day of the shoot a $75 fee will be assessed.​

Substitute Photographer
​
Reside Photography reserves the right to substitute with another photographer. The substitute photographer is chosen at the discretion of Reside Photography and does not constitute a breach of this Contract. Reside Photography warrants the substitute photographer to be of comparable quality and professionalism.

Travel and Overage Fees
​
The CLIENT shall pay $0.75 per mile outside the Zip code of 32837. ​

Images on website​
​
All images and media on this website are the exclusive property of Reside Photography LLC and are protected by copyright law. Any unauthorized use, reproduction, or distribution of these materials without prior permission is strictly prohibited and constitutes a violation of the Digital Millennium Copyright Act of 1998 (17 U.S.C. §512(c)). Infringement of these rights may result in legal action.

Property Preparation and Photography Session
To ensure optimal results, the CLIENT is responsible for preparing the property before the scheduled session. This includes cleaning and organizing the space. While the photographer may make minor adjustments, such as repositioning small items, controlling lighting, or adjusting window coverings, furniture relocation is the CLIENT’s responsibility.

The CLIENT must provide a safe working environment, free from hazards, and ensure that pets are confined and out of view during the session.

Reside Photography does not retouch images to conceal known defects or permanent features, such as wall blemishes, floor cracks, or power lines, unless specifically requested and agreed upon prior to the session.
To expedite the process, it is recommended that:

Lights are turned on.

Vehicles are removed from driveways.

Window shades are raised.

Patio umbrellas (if applicable) are opened.
If the CLIENT is not on-site, the photographer will make these adjustments as necessary and return everything to its original state at the end of the session.

Payment Terms
Payment is required before image delivery. Reminder notices will be sent until payment is received. Once payment is made, a formal receipt will be issued.

Failure to remit payment will result in a request to remove the images from the listing. Additional action may be taken with the MLS under DMCA Copyright Laws.​​​
​
Photographer’s Standard Price List
​
The charges in this Contract are based on the Reside Photography's Standard Price List. This price list is adjusted periodically and future orders shall be charged at the prices in effect at the time when the order is placed.
Post-Production & Editing Policy
​
Delivery of edited images are usually delivered within 1-2 business days from completion of shoot. Please note that delivery times may vary. The CLIENT should place orders with sufficient time to allow for normal delays and notify Reside Photography at the time of the order if there are any extenuating circumstances requiring a quicker turn around.

Arbitration
​
Any controversy or claim arising out of or relating to this Contract, or the breach thereof, shall be settled by arbitration, administered in accordance with the Commercial Arbitration Rules of the American Arbitration Association, administered by a licensed Arbitrator in the jurisdiction closest to the Reside Photography's office and the arbitration award may be entered for judgment in any court having jurisdiction thereof.

Indemnification
​
Reside Photography and its photographers shall be held harmless for any and all injury to the CLIENT and the CLIENT'S property during the course of the photographic event and the immediately surrounding events.

By commissioning Reside Photography, the CLIENT agrees to adhere to the terms outlined in this agreement.
